Hi, My brother was involved in an assault case last year and had a court date set for January 2007. Lawyer was paid for, and due to personal reasons, he told the lawyer he would be leaving the country and will be back by the court date to attend it. But again, due to personal reasons, he was not able to make it back to Canada by January 2007 to attend the court date. Its now January 2008 and he wants to come back to canada, Is there any problem for him coming back here? we contacted the lawyer that we had before, and she said that he has to send her $5000 before coming back to Canada, Is this really necessary? Is he not legal to come back? He is permanent resident in Canada, same with all of my family.
If he failed to appear in court on the assault case there is probably a bench warrant out for him. They may have his passport flagged through customs, and if he attempts to enter back in to Canada he may be arrested at the airport. It would be best for him to pay the attorney the money she is requesting and have her at the airport when he arrives so that he can have the benefit of legal assistance in order to protect his rights. He is coming back voluntarily and the court will take that in to consideration.
